Copyright Infringement Policy

Notice and takedown procedures under the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Designated Agent

2. How to File a DMCA Notice

If you believe that content on this Website infringes your copyright, please send a written notification to our Designated Agent containing all of the following elements (17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled, and information reasonably sufficient to permit us to locate the material.
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may send a written counter-notification to our Designated Agent containing all of the following elements (17 U.S.C. § 512(g)(3)):

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or, if you are outside the United States, any judicial district in which EC Home Realty may be found), and that you will accept service of process from the person who provided notification of the alleged infringement.

4. Disclaimer

EC Home Realty will respond to valid notices promptly. In accordance with the DMCA and applicable law, EC Home Realty may, in appropriate circumstances, terminate or disable the accounts of repeat infringers.

5. Forwarding of Notices to Stellar MLS

As an IDX participant, EC Home Realty is required to notify Stellar MLS of any claimed copyright infringement relating to listing data displayed on this Website. Any DMCA notice we receive is forwarded to Legal@stellarmls.com no later than twenty-four (24) hours after receipt, as required by the Stellar MLS IDX Rules (Article 19.30).

6. Stellar MLS Designated Agent

The Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512 (the "DMCA") provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that any content or material made available in connection with our website or services infringes your copyright, you (or your agent) may send us a notice requesting that the content or material be removed, or access to it blocked. Notices will be forwarded to the designated agent of Stellar MLS (My Florida Regional MLS, Inc.): Stellar MLS, 247 Maitland Avenue, Suite 2000, Altamonte Springs, FL 32701, Legal@stellarmls.com, (407) 960-5300.

The DMCA requires that your notice of alleged copyright infringement include the following information: (1) description of the copyrighted work that is the subject of claimed infringement; (2) description of the alleged infringing content and information sufficient to permit us to locate the content; (3) contact information for you, including your address, telephone number and email address; (4) a statement by you that you have a good faith belief that the content in the manner complained of is not authorized by the copyright owner, or its agent, or by the operation of any law; (5) a statement by you, signed under penalty of perjury, that the information in the notification is accurate and that you have the authority to enforce the copyrights that are claimed to be infringed; and (6) a physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf. Failure to include all of the above information may result in the delay of the processing of your complaint.
